#1 - Use of website
I, a provider of information used on the ObituariesToday.com website confirm and warrant that I:
- Have attained the legal age of consent, that am entitled to enter into legal agreements and I agree to contract with OT on all of the terms set out on all legal notices on the OT website.
- Believe that the information I provide to OT information for use on the OT website that is to the best of my knowledge and belief, truthful, and accurate.
- Consent to the use of the information I supply to OT by OT
- Agree to deliver payment in full for the services of OT within 10 days (not including weekend and holidays) from the date the information I deliver is posted on OT’s web-site and if I do not deliver full payment the information may be removed from the web-site by OT
- Agree that OT shall have the right to edit, delete or otherwise modify any information supplied by OT if OT in its sole discretion considers the information inappropriate, offensive, libelous, degrading or objectionable for any other reason
- All information I provide to OT shall become the property of OT.
- Will provide OT with correct information if I have inadvertently provided inaccurate information. OT may be contacted by going to OT’s CONTACT US page and following the instructions found there.
- I assume full responsibility for all information delivered to OT and I further agree that OT including any of its directors, officers, employees, affiliates, associates or agents shall not in any way be held liable for information I have delivered to OT
- All disputes shall be settles by mediation with the mediator to be located in the city of Hamilton, Province of Ontario, Canada, failing which all disputes shall be settled by application to the Superior Court of Justice at Hamilton Ontario, Canada and all parties attorn to that jurisdiction.
- The proper law of the contract is the law of the province of Ontario or Canada as applicable.
#2 - Other Terms and Conditions (applicable to all users and viewers of OT’s website)
- Neither OT or it’s directors, officers, employees, affiliates, associates and agents assume any liability whatsoever for any use of any information appearing on the OT website by others including any consequential damage.
- If any individual leaves his her or its e-mail on the OT website he she or it understands that this may result in unsolicited e-mails for which OT bears no responsibility.
- OT reserves the right in its sole and unfettered discretion to edit, modify or delete any information appearing on OT’s website.
- Unless otherwise stated all information appearing on OT’s website its the property of OT
- All designs of OT’s website and its contents is the property of OT or its associated legal entities and shall not be copied, reproduced, distributed, republished, downloaded, displayed, posted in any form or by any means without the expressed written consent of OT. The prohibition set out in this paragraph does not extend to the downloading or e-mailing of the contents of the website for the personal use (as opposed to the commercial use) of the recipient.
- O.T. does not warrant or make any representation that the information on its website is accurate. O.T. accepts no responsibility for any damages arising from the use of any information on OT’s website by any third parties including damages for negligence, loss of profit, or any consequential loss of any sort whatsoever. The use of information on OT’s website is at the user’s own risk.
- A link to any other website does not constitute an endorsement of the content of that website by OT and OT does not take any responsibility for the use of the information supplied to the public by any websites linked to OT.
- OT does not warrant that its website is completely free of computer viruses or other malicious or detrimental computer programs. The users of the site must do so at their own risk.
